my sister was married for two years had a child by this man . he got killed on his job and she drew ss for herself and the child. she later remarried an older man they divorced ;her child by the first husband is now grown , she has been claimed mental from nervous brake down , and says she can go back and draw ss from her first husband of the two year marriage, because she has a child by him ,although the child is now grown and thirty four years old . the child has had total hip replacement. a defect from birth ,and draws ss herself . can my sister actually be telling the truth , she has applied for ss on her first husband of only two years just because she has a now grown child by him ; even after she has remarried and divorced the second time ?

Dear Roberta: You have the facts correct, but it is not exactly how it goes. Your sister can file for Disabled Widows but I think her prescribed period is over. She would have had to be entitled to her first husbands benefits within 7 years. By what you are saying, it has been longer than that. She would have to file for her own disability. She could, however, file for regular widows benefits at age 60. Her disabled older child has nothing to do with the benefits she is now applying for.........Carol
