SS of ex-husband

Social Security Answer:

I was married for 32 years. Am I entitled to any of my ex's SS? Even if he is re-married? I have been a teacher for 8 yrs...should I be entitled to his SS should I stop putting into teacher retirement? I am 57 yrs old. How does this all work. I also seem to get a different answer when I call or talk to them at the SS office. He makes tons more money than I do or every will have the opportunity to.....so wouldn't I get more SS from him than the small amount I have saved In Teacher retirement.

Dear Becky:
First of all, yes you are entitled to his benefits if yours is not more than his.
Ex-wife benefits is based on 1/2 of his full benefit, so many wifes are not eligible until the husband is deceased, at which time it would be based on his whole amount. If your school pension is based on non-fica earnings, then there will be a 2/3's offset of what you pension amount is. That means, SS will take your SS benefit from your husband and deduct 2/3's of your pension from that amount. If you paid fica taxes on the earnings and it is a private pension, then it will not count against you.
You should check out the situation at age 60, unless your husband dies before.
Widows benefits start at age 60.......Carol
