my son is 12yrs old.
I'm 73 and getting social security for myself.
Can he get social security??

Support Replied ~ 08-16-2009 19:13:22

Dear Paul
Yes, if he is your biological son. If he is your step-son, there are different rules.
You should definitely call SS now. You could be eligible for retro benefits.
What about your sons' mother? She could be eligible also. I can't believe that SS took an application and did not tell you a minor child was eligible. Where did you apply? Call and mention that you have been on SS and they did not ask you about
the child. Mention mis-information. Carol

Carol, thanks so much for responding.
My son is not biological.
However, I did adopt him and he has my name. I signed the
birth certificate.
What are the rules?

Support Replied ~ 08-17-2009 19:00:10

Dear Paul:
He was eligible as of the month that you adopted him. However, if that month is more than 6 months ago, you might have lost some money. He could be receiving 1/2 of your check amount. That is extra money that you could use I am sure. You need to call your local office or the toll free number at 1-800-772-1213...Good Luck....Carol

thanks for everything
they said it can go back only six months
is that right
he got his 1st check yesterday - its 1/2 of mine

thanks again

Dear Paul: Yes, 6 months retro is correct. Did you adopt him after you filed for benefits? If so, that is why SS didn't know about him before. If you adopted him before you filed for benefits.....then call SS and tell them you got misinformation.
It is their fault there was not child's claim taken......Carol
