Hi, MY HUSBAND BECAME DISABLED IN SEPTEMBER OF 2006 AFTER A WORK RELATED INJURY. HE CURRENTLY GETS WORKMAN'S COMP AND SOCIAL SECURITY DISABILITY WITH AND OFF SET. IN SEPTEMBER OF 2008 HE PROPOSED AND WE WERE MARRIED IN NOVEMBER OF 2008. I HAVE MULTIPLE HEALTH AND MENTAL HEALTH ISSUES AND APPLIED IN 2004 FOR SOCIAL SECURITY AND SSI. AT A HEARING LEVEL I WON MY CASE IN SEPTEMBER OF 2008 AND MY BENEFITS STARTED IN OCTOBER 2008. THEY ARE STILL FIGURING OUT WHAT MY RETROCATIVE BENEFITS ARE AND IF I AM ENTILTLED TO ANY SSI PRIOR TO MARRIAGE. RIGHT NOW EVERY THING IS A MESS WITH CHANGE OF NAMES ETC... MY QUESTIONS ARE 1.) MY BENEFIT IS QUITE LOW AND I AM ONLY 48. MY HUSBAND IS 58. CAN I APPLY UNDER HIS SINCE HIS PAYMENT IS HIGHER OR DO I HAVE TO WAIT UNTIL 62? HE WAS MARRIED FOR 27 YEARS PRIOR AND DIVORCED FOR 6 YEARS. DOES THIS AFFECT ME AS THE NEW WIFE? THIS WHOLE PROCESS IS VERY CONFUSING. SOCIAL SECURITY OFFICE IS NOT VERY HELPFUL AT ALL. CAN WE APPLY FOR A SUPPLEMENTAL INSURANCE FOR BOTH TO COVER EXCESS MEDICAL OR DOES IT HAVE TO BE DONE INDIVIDUALLY. THIS HAS NOT BEEN AND EASY PROCESS AND I AM BEING GIVEN AND EXTREMELY DIFFICULT TIME BY LOCAL OFFICE. ADDITIONALLY AND APPEAL WAS MADE RE; ATTORNEY FEE SINCE HE WAS PAID BY SOCIAL SECURITY RE: MY HUSBANDS APPLICATION. WE WERE TOLD IT HAD TO GO TO A HEARING LEVEL INITIALLY AND AFTER HIRING AND ATTORNEY SOCIAL SECURITY MADE A RECONSIDERATION ON THERE OWN AND OPENED HIS CASE AND PAID THE LAWYER! WE APPEALED THE FEE SINCE HE DID NOT HAVE TO REPRESENT MY HUSBAND AND THEY PAID HIM ANY WAY CANNOT FIND THE LETTER OF APPEAL AND IT WAS NOTAIZED AND SENT CERTIFIED MAIL. THIS HAS BEEN GOING ON FOR MONTHS. COPIED IT ALL AND SENT IN A SECOND TIME. LOCAL OFFICE SAY'S THEY CANNOT FIND IT! PLEASE HELP WITH ANY SUGGESTIONS YOU MAY HAVE. THANKS, LIZ

Dear Liz: There are no wife disability payments, so you will have to wait to be a 62 wife. His exwife can apply for ex-wifes benefits at 62 provided he is 62. Her benefits has no affect on his or your benefits. If you didn't hire the attorney until the hearing stage then SS shouldn't have paid him. If youo have the certified mail receipt, then the post office should have some proof of that envelope. You should really be dealing with a supervisor on this issue of the atty rep fee. If you cannot get any service from your local office, contact your senator or congressman and they will get you some action......Carol
