Social Security Question:

marriage length be before a widow can file for widower's social security

Social Security Answer:

Is there a time limit on the length that a marriage has to be before a widow can file for widower's social security....not survivor's benefits but my husbands social security.......i am disabled, 56 yrs old and my husband died last year of esophageal cancer...we were together 13 years and can prove that...we filed taxes...however we got married in march before he died in october..we had planned the wedding long before we found out he had cancer...but the end of march we found he had cancer and not a long survival but it should have been 2 years instead of 6 months....i can't live on what i get each month from my ss and i am raising 2 grand children....i cannot believe that social security (in this day and time) has not passed a law about people living together as man and wife...oh well i am sorry to go on and on but i get upset about the situation

There is disabled widow benefits for the situation you described. You can file for these benefits stating that you did not know that he would die in so few months. That you had planned on getting married. Also there is common-law relationships, which you had. Check on that. There are also grandchild benefits if the parents of the children were deceased or disabled. Are the children disabled?-there could be benefits for that. Also, welfare pays benefits to grandparents that have custody of their grandchildren. Call your local office and tell them you want to file for disabled widows. If they deny you, put in for a reconsideration within 60 days, and if they deny that file for a hearing before a law judge. Get legal assistance to help you. That is your best bet-good luck-let me know what happens.
