Carol, My Mother-in-Law recently lost her husband after 66 years of marriage. She was told by the Social Security Office that she would receive a small portion of his benefit as a surviving Spouse. She went to her appointment at the local Social Security Office with my Wife and was then told that she would get none of his benefits since her benefit amount was $4.00 per month more than his. She only recieves a little over $900.00 per month and we are trying to determine if the Social Security Office actually gave her the correct information. They seemed confused and unorganized according to my wife and I can not find any reference to this on the Social Security website. Regards, Chris Burt

Dear Christopher: When one spouse dies, the remaining spouse does get the higher amount. With women working more these days, the situation you described does happen. Since your mother-in-law is over 66, she would get her husbands amount. Look on their bank statement and see what he was getting. Unless he worked after retirement age, the amount should be about the same. If he did work after retirement, he would have gotten delayed retirement credits that she would not get. Let me know what you find out.
