Social Security not enough credits

i am a 40 yr old woman. i have file for ssi waiting for a court date. i have work before but was told i was short 4 credits. been married for 10 yrs. with two children. but were seperated not legally. my question is if im approved for my disability can i receive ssd off of his work credit? also will my children be able to receive benefits as well? he receive 123.00 for veteran disability. being only 10% disable but still working. we have a disable son that receives ssi.

Dear Janice:
If you have only 4 credits to earn for your own disability, try to earn it....You could work part time and as long as you don't go over $900 a month, you can still be considered for disability. You cannot get disability from your husband unless he is dead...It is called disabled widows benefits. Your son will be eligible for disabled child's benefits when your husband files for retirement or disability or passes away. Make sure he tells Social Security that the child lives with you.....If he files for benefits and says the child lives with him, then he will get the checks.

if i get approve for ssi will i lose the credits i already have? meaning basicly starting all over to get the 20 credits i need to qualify for ssd. if i'm able to work part time

Dear Janice:
No you will not lose credits, but you must have worked 5 out of the 10 years before your disability date....So, if you don't get the quarters until next year, you will have had to have earned the quarters within 10 years of your disability date. If your work was heavier in the early years, then you might lose some.....It is hard to say without knowing what your earnings record looks like. However, you will not lose all and have to start all over.....You can call SS and ask them to look at your earnings record and see if it is worth your while to get a part time job to become insured for regular disability...Carol
