I was a buyer for Macys Dept. store for 20 years and paid into social security. I went back to school and got my teaching credential. I have been teaching now (in Nevada) for sixteen years and was told about the above statutory requisites. My understanding is they apply at time of retirement. I will be sixty-five in March, 2009 and ask you if I take a reduced amount at 65 and not wait until 66, can I collect my social security while I am still working. I estimate my reduced amount to be $850/month and I intend to work for 2-3 more years. I know former Pres. Clintons' administration passed social security changes allowing 65 plus to continue working and also collect their socal security..I am optimistic that the new congtess and Pres. Obama will change the aforementioned descriminating laws.

Unfortunately, your FRA year is 2010. That year you are allowed to make at least $37680 from january until february. Therefore, you should apply for benefits for january 2010. Also, your benefit rate will be increased because of your later work.
SS uses the highest 35 years of earnings for your benefit rate, so it will be adjusted
every year that your earnings are better than the 35 years they used. About the windfall offsett and gov pen offset--the earnings in Nev are non-fica? You still have about 20 yocs (years of credit) which will reduce the WEP. I dont think they will ever eliminate the Gov Pens. Offiset because there is such a small group of people that it affects......I am one of them......Take care....Carol
