I am a teacher with over 40 Social Security quarters but less than 20 years of substantial earnings. I am 66 years old and am still working in a state (Louisiana) in which I do not pay SS. Because I am working past full retirement age and have not yet started to receive my government pension, WEP is not being applied to the Social Security benefit that I receive. This benefit is based on my own as well as a former husband’s earning record. (I currently receive an amount equal to half of his since it was higher than my own.) The question: When I do retire and begin receiving my teacher retirement, will WEP be applied to the Social Security benefit I would receive based ONLY on my own earning record or the higher Social Security retirement benefit based on my own and a former spouse’s record. The former spouse to whom I was married for 20 years is still living. Thank you so much.

Dear Virginia: When you report to Social Security that you are receiving a pension based on work that was not covered under FICA, you will be subject to WEP and GPO. The Wep will reduce your own benefit and the GPO will most likely wipe out your spouses benefits. (GPO is figured out by taking your state pension at 75% and reducing your spouses benefit dollar for dollar...Not good news....You should remember to contact Social Security when your spouse dies, since widows amount is double the spouses, and you might be eligible for something even with your state pension.....Carol
