Husband and I are going to file SSA 521 forms soon, but are having difficulty in figuring out when to make effective so that we receive our soc sec checks in Dec (for Nov. benefits), and refile to receive Jan. 2009 checks. We understand that once we file, SSA will send us approval within 30 days with amt to be paid. We immediately send amts owed, and THEN checks stop? We receive receipt of amts paid within 30 days? Once receipts received, we refile effective Jan 1, 2009? Have looked all over for procedures and "timing" involved to no avail. Local SSA ofc handed us an outdated form.

What you are doing is not that common. The form has to be sent to the Payment Center. Can you figure out how much you have received? Call your local ss and ask them for 1099s for the years you have received benefits. It will be fairly easy for SS to suspend your checks. If you turn in a check with the form, the returned check will be posted on your acct within a week.(or it should be) The trick is to get you reinstated with all the correct info on your acct. If you are over 65, Medicare could be a problem. If you go into an office in mid December, you will have received your Nov benefit (dec check). Tell them you want checks stopped with Dec (January benefit). File a new retirement claim that day and it will protect you for Dec.(jan check). SS has to wait until the payment center changes the code on your claim to show that it is withdrawn. Then it has to post the new application. That could take a while. The only person that can say how long, is the person who is working on it at the payment center. It could take 2-3 months to get you the correct amt in your check. What I am saying, is that this is a manual procedure. Keep the name and the tel number of the person who is helping you with this. Also, get the supervisors name. Find out how long it will take to recoop the money that you gave back. Get back to me if anything is confusing. The main answer is, no one can give you an exact timeline as to how long this will take.
