My husband recently passed away. He was 67 and I am 63. We were married for 3 years. I was told I can't receive any benefits because I work full time and make more than $14,160. I heard that in 2010 I will be able to work full time and collect benefits. Because we were only married for 3 years and his ex-wife is currently collecting his benefits now, will I receive a reduced benefit or no benefits at all?

Dear Karen: You are subject to the work test, $1 for every $2 over the $14160 (this year). If you are earning about $40000, it would make no sense to file, since SS holds first and after they take the overage away, you would not be due anything this year. Next year there will be a new amount that you can earn, but it will still be the $1 for $2 as it is this year. It would change in your 66th year. The ex-wifes benefits do not affect your benefit at all. Carol
