1. My wife did not qualify for disability benefits because she has not worked long enough under social security. My question is how can a person like my wife who is mentally and emotionally disabled and unable to work ever qualify? Because she does not have enough credits they will not even make a decision about whether she is disabled under Social Security rules, yet her disabilities are listed as qualifiers under their own rules as being disabled and her medical records will prove it? 2. SSI was denied to her even though she has no personal assets, the denial was based on my assets. In other words she is being penalized because she cannot work (no SSDI) and is married (no SSI). The local Social Security staff only states why she didn't qualify and will not answer these two questions. Where do I now go to get benefits for my wife's disabilities?

Dear Gary: Unfortunately you are in a rough situation. There are two types of SS disability. One is based on your earnings, the "premium" so to speak being paid by your fica taxes. Since your wife did not pay the premiums, she cannot get the insurance. Its like your house burning down and you never had fire insurance. SSI is a needs based welfare kind of disability. It is not an entitlement program like SSDI. Your assets are considered her assets. You would not expect a millionaires wife to be on welfare because she has none of his money in her name. She still gets the benefit of her husbands windfall. I dont know why SS did not answer your questions to these two issues. It is pretty black and white. Your wife was inelligible because she is living with you as her husband. If she was seperated, she probably would be eligible. The only kind of disability insurance that she could get would be private insurance. I am not sure if she could get it since she is already disabled.
