Social Security Question:Divorcee Benefit
Social Security Answer:
I am divorced from my ex for 19 years. We were married for almost 25 years prior to the divorce. I have been collecting my SS payments since I turned 62, I am now 65. I have been told that I should be able to collect based on my ex’s SS payment which is higher than the amount I receive. He will is currently collecting at age 66. Is it true that I can appeal to SS to have my benefit increased to the amount he receives which is more than double that which I receive? Thank you for your help.

Dear Sandra:
If you were divorced when you filed for your benefit, SS should have checked out your ex-husbands amount to see if you were eligible for some of his.....They should have asked his name and date of birth....Spouses benefits are figured out as follows: Take the husbands amount...for example $1800....Take the wifes full retirement rate amount....say $800....The spouse benefit is based from 1/2 of the full retirement rate amount....So 1/2 of $1800 is $900.....subtract the wifes full retirement amount which is $800 and reduce the $100 excess for the number of months the spouse is under age 66.
If your full retirement amount is more than 1/2 of his full retirement amount, then you would not be eligible for any spouses benefits....BUT when he passes , you will be eligible for his full amount. Marriages after or before will not alter that fact....Hope I helped....If your full retirement amount is less than 1/2 his full retirement amount....then you are due benefits now.....You can call the toll free number if you do not know his full retirement amount and they will check to see if you are eligible for benefits.....Or you can rewrite me with your and his full retirement amounts....Carol
